EQUAL EMPLOYMENT OPPORTUNITY


WHAT IS EEO?

The idea that everyone should be treated fairly when they’re considered for various employment decisions such as hiring, promotion, termination, compensation, etc. This means, for example, that anyone competing for a position at a company should have the same chances of succeeding if they’re right for the job.


Employers can't discriminate against their employees on the basis of 
  • Race
  • Age
  • Color
  • Sex
  • Religion
  • National origin
EEO Regulations



Equal Employment Opportunity is legislated by U.S. Equal Employment Opportunity Commission (EEOC) which has been established by Title VII of the Civil Rights Act of 1964 for the protection of United States Employees from discrimination.


This applies to employers who employ 15 or more employees. Most labor unions and employment agencies are also covered.
As an example, according to several EEO laws, employers can't reject a candidate simply because they're male or female, Buddhist or Christian or because they're pregnant. Basically they can't even advertise jobs asking for candidates who are in  certain age, and they can't even promote men over women. You can only base your decision on each candidate's proven capabilities,performance and other objective criteria rather than basing against protected groups.  






Bona Fide Occupational Qualification


EEO does have some exceptions that concerns protected characteristics. These exceptions of the EEO definition are called Bona Fide Qualifications (or “genuine occupational qualifications” in the UK) for a specific job. The nature of certain jobs may allow employer to make employment decisions based on one of the protected characteristics.
Eg: If a company makes clothes for women, it can advertise for female models.

Of course yes Samadhi,In accordance with the Constitution of Sri Lanka, there cannot be any discrimination on the grounds of race, religion, language, caste, sex, political opinion, place of birth or any one of such grounds. There is no special provision in constitution or labor laws to prevent discrimination in employment related matters. Laws also prohibit discrimination against disabled persons in matters of employment as well as workers involved in union activities.
      Also Constitution of Sri Lanka gives every person the right to apply to the Supreme Court in respect of violations of fundamental rights by the State (executive action). It is not clear whether individuals can obtain redressal with respect to discrimination by the private sector employers.

  3. Hi Hasangani, i personally think it would be more relevant and useful if you base your topic more regarding Srilnka or South Asia, and why most of the companies in srilanka not focusing on EEO, also you can compare why other develop countries keen on this...

    1. Hi sajitha, Please check my reply to Samadhi's comment. I've explained how it can be applied for Sri Lanka according to the Constitution of Sri Lanka. EEO regulations also have been applied for Sri Lankan Labor Laws. Any way why do you think that it can't be related to SL or South Asia? πŸ‘€

I saw the comment & agreed but i didn't focus on the legal side and focus more why srilankan companies didn't focus on EEO, when compare to other countries..yes there is the Law in srilanka,though employees not educated enough about the law and their rights..so the employer can take advantage on this and didn't pay mach attention on EEO..

    3. I got your point. That’s why we should promote this and make them aware about this regulations. But as a good leader, he/she follow EEO regulations not just it because a regulation Bcz it’s the right thing to do. So It’s not a fault of employee because of they don’t aware, it’s the fault of the management who don’t be fair when they take decisions.

    1. Yes you're correct Buddima. But if you hire or promote a candidate you shouldn't consider the generation first. You should consider the qualification and the talent of the candidate, not age. But according to the "Bona Fide Qualifications" you can customize your requirements according to their regulations.😊

  5. Hi, EEO is most factor in cooperate world. Personally I believe in Sri Lanka private sector treat their employees in EEO manner, but yes there are some incidents reported against EEO not only in Sri Lanka around the world. Anyway nice article, it is good if you can specify pros and cons of EEO considering both employer and employee side.

  7. I don't think that in Sri Lanka, there is a EEO Act established. But same was discussed somewhat in Sri Lankan constitution.

    Eg-
    1) In accordance with the Constitution of Sri Lanka, all persons are equal before the law and entitled to equal protections of the law.

    2) There cannot be any discrimination on the grounds of race, religion, language, caste, sex, political opinion, place of birth or any one of such grounds.

    3)Every citizen is entitled to the freedom to engage by himself or in association with others in any lawful occupation, profession, trade, business or enterprise. However, certain labour law prohibit employment of women in the same industries as men (especially mining sector).
